Date: 11/21/2012

Agriculture is Georgia's No. 1 industry, and that is especially true here in House District 176. During the last legislative session, we approved House Bill 386, which includes a provision that created the Georgia Agricultural Tax Exemption (GATE) program, which offers qualified agriculture producers a sales tax exemption on agricultural equipment and production inputs.

The new law also established a GATE certificate, issued by the Georgia Department of Agriculture, to identify its user as a qualified farmer or agricultural producer. The program replaces the Agricultural Certification of Exemption (ST-A1) form. Those applying for the certificate will be charged a $20 fee for all online applications and a $25 fee for applications requiring assistance (i.e. mail and call center).

You can now register for the Georgia Agriculture Sales Tax Exemption (GATE) certificate online through the Georgia Department of Agriculture. Click here to access the online application - then go to "NEW APPLICATION" on the left corner of the page to get started. The online cost is $20 and certificates are usually issued within a minute of submitting the application and making credit card payment (MasterCard or Visa).

Effective January 1, 2013, a qualified farmer, nursery operator or ag processor must have a certificate issued by the Georgia Department of Agriculture in order to receive the exemption of sales tax on ag inputs and energies. The GATE application, rules and brochure are available at the links below for your reference. The annual cost is $25 for a paper application. Payment can be made to the Georgia Department of Agriculture with a check.

Please check the Frequently Asked Questions document if you need assistance. You may email questions or comments directly to farmtax@agr.georgia.gov or contact the Georgia Department of Agriculture call center between the hours of 8am and 4:30pm M-F, at 855-327-6829.
